Gemini’s Lawsuit Against Digital Currency Group:
A Fight for Justice

Crypto trust firm Gemini has taken a bold step against the industry conglomerate, Digital Currency Group (DCG), and its founder Barry Silbert. The lawsuit alleges that DCG committed “fraud” through its subsidiary Genesis, which held funds tied to Gemini’s Earn program.

The Genesis of the Dispute: A Partnership Gone Wrong

Gemini had entered into a partnership with Genesis, allowing its customers to earn up to 7.4% in annual percentage yield. The funds from Gemini’s customers were sent to Genesis, which then loaned them out to companies like the now-defunct Three Arrows Capital.

The Allegations: Unmasking the Deception

The lawsuit alleges that Silbert asked Gemini to continue its Earn program despite knowing that Genesis was “massively insolvent.” It is alleged that Silbert took steps to hide the fact that Genesis had a billion-dollar hole in its balance sheet. Genesis filed for bankruptcy in January 2023.

The Aftermath: Gemini’s Fight for Redemption

In a tweet, Gemini co-founder Cameron Winklevoss, who previously invited Silbert to join him on a Twitter Space without lawyers, called Silbert “the architect and mastermind of the DCG and Genesis fraud against creditors.” The lawsuit, which alleges fraud and aiding and abetting fraud, is seeking damages, attorney’s fees, and “any other relief that is deemed just and proper.”
